Title: Examining Physicists' Ethical Reasoning: A New Methodology
Researchers across all scientific disciplines routinely face ethical decisions in their work, from addressing conflicts of interest to deciding whether and how to make data available for reproducibility. To help strengthen their ethical reasoning skills, they are encouraged to take online training programs like the CITI program. Ethics training is insufficient for improving ethical behavior. Better understanding of how scientists make decisions and reason about ethics is needed. To develop that understanding, we need expanded, asset-based measures of ethical reasoning that can be applied to open-ended responses and discussions. As part of a year-long intervention on a group of fifteen scientists' value-based reasoning, we conducted pre/post interviews that included open-ended questions about ethical scenarios. For this paper, we explore an application of three theories of ethical and stakeholder reasoning to those answers, and determine that we can use them to examine quality, principles, and subjects of their reasoning in open responses.  more » « less

  1. This Innovative Practice Full Paper presents a novel, narrative, game-based approach to introducing first-year engineering students to concepts in ethical decision making. Approximately 250 first-year engineering students at the University of Connecticut played through our adventure, titled Mars: An Ethical Expedition, by voting weekly as a class on a presented dilemma. Literature shows that case studies still dominate learning sciences research on engineering ethical education, and that novel, active learning-based techniques, such as games, are infrequently used but can have a positive impact on both student engagement and learning. In this work, we suggest that games are a form of situated (context-based) learning, where the game setting provides learners with an authentic but safe space in which to explore engineering ethical choices and their consequences. As games normalize learning through failure, they present a unique opportunity for students to explore ethical decision making in a non-judgmental, playful, and safe way.We explored the situated nature of ethical decision making through a qualitative deconstruction of the weekly scenarios that students engaged with over the course of the twelve-week narrative. To assess their ethical reasoning, students took the Engineering Ethics Reasoning Instrument (EERI), a quantitative engineering ethics reasoning survey, at the beginning and end of the semester. The EERI scenarios were deconstructed to reveal their core ethical dilemmas, and then common elements between the EERI and our Mars adventure were compared to determine how students responded to similar ethical dilemmas presented in each context.We noted that students' responses to the ethical decisions in the Mars adventure scenarios were sometimes substantially different both from their response to the EERI scenario as well as from other decisions they made within the context of the game, despite the core ethical dilemma being the same. This suggests that they make ethical decisions in some situations that differ from a presumed abstract understanding of post-conventional moral reasoning. This has implications for how ethical reasoning can be taught and scaffolded in educational settings.

  2. Ethics as long been recognized as vital to responsible engineering practice, with research focusing mostly on the effects of ethics pedagogies and programs on ethical reasoning and knowledge. Historically, engineering ethics has tended to be “normative” – telling people how they should think about or behave in engineering. Recent work in moral and cultural psychology has called into question the extent to which ethical judgements are based primarily ethical reasoning. Ethical judgments are also the result of intuitions, emotions, and held values. The authors argue that more empirical research using this perspective is needed to explore first-year engineering students’ ethical intuition. As such, this quantitative and qualitative research study examines the relationship between moral intuitions, measured using the Moral Foundations Questionnaire (MFQ), and student-held values about what is important in the engineering profession. Around 285 first-year engineering students were surveyed at a public university in the northeast United States as part of a larger research initiative that seeks to understand the effects of diverse cultural and educational experiences on ethical judgements in engineering. This paper reports the findings from a portion of this survey, namely the MFQ and the open-ended question “List three values you think are the most important for defining a good engineer”. Descriptive and correlational analyses are employed to examine meaningful connections between moral intuitions and values. Since moral foundations theory is based on a broader, more inclusive understanding of ethics, results from this research can be more easily generalized, compared, and built on in increasingly cross-cultural settings.

    A quiet revolution is afoot in the field of law. Technical systems employing algorithms are shaping and displacing professional decision making, and they are disrupting and restructuring relationships between law firms, lawyers, and clients. Decision-support systems marketed to legal professionals to support e-discovery—generally referred to as “technology assisted review” (TAR)—increasingly rely on “predictive coding”: machine-learning techniques to classify and predict which of the voluminous electronic documents subject to litigation should be withheld or produced to the opposing side. These systems and the companies offering them are reshaping relationships between lawyers and clients, introducing new kinds of professionals into legal practice, altering the discovery process, and shaping how lawyers construct knowledge about their cases and professional obligations. In the midst of these shifting relationships—and the ways in which these systems are shaping the construction and presentation of knowledge—lawyers are grappling with their professional obligations, ethical duties, and what it means for the future of legal practice. Through in-depth, semi-structured interviews of experts in the e-discovery technology space—the technology company representatives who develop and sell such systems to law firms and the legal professionals who decide whether and how to use them in practice—we shed light on the organizational structures, professional rules and norms, and technical system properties that are shaping and being reshaped by predictive coding systems. Our findings show that AI-supported decision systems such as these are reconfiguring professional work practices. In particular, they highlight concerns about potential loss of professional agency and skill, limited understanding and thereby both over- and under reliance on decision-support systems, and confusion about responsibility and accountability as new kinds of technical professionals and technologies are brought into legal practice. The introduction of predictive coding systems and the new professional and organizational arrangements they are ushering into legal practice compound general concerns over the opacity of technical systems with specific concerns about encroachments on the construction of expert knowledge, liability frameworks, and the potential (mis)alignment of machine reasoning with professional logic and ethics. Based on our findings, we conclude that predictive coding tools—and likely other algorithmic systems lawyers use to construct knowledge and reason about legal practice— challenge the current model for evaluating whether and how tools are appropriate for legal practice. As tools become both more complex and more consequential, it is unreasonable to rely solely on legal professionals—judges, law firms, and lawyers—to determine which technologies are appropriate for use. The legal professionals we interviewed report relying on the evaluation and judgment of a range of new technical experts within law firms and, increasingly, third-party vendors and their technical experts. This system for choosing technical systems upon which lawyers rely to make professional decisions—e.g., whether documents are responsive, or whether the standard of proportionality has been met—is no longer sufficient. As the tools of medicine are reviewed by appropriate experts before they are put out for consideration and adoption by medical professionals, we argue that the legal profession must develop new processes for determining which algorithmic tools are fit to support lawyers’ decision making. Relatedly, because predictive coding systems are used to produce lawyers’ professional judgment, we argue they must be designed for contestability— providing greater transparency, interaction, and configurability around embedded choices to ensure decisions about how to embed core professional judgments, such as relevance and proportionality, remain salient and demand engagement from lawyers, not just their technical experts.

  4. Ethics has long been recognized as crucial to responsible engineering, but the increasingly globalized environments present challenges to effective engineering ethics training. This paper is part of a larger research project that aims to examine the effects of culture and education on ethics training in undergraduate engineering students at universities in the United States, China, and the Netherlands. We are interested in how students’ curricular and extra-curricular (e.g., internships, service projects) experiences and training impact their ethical reasoning and moral dispositions, and how this differs cross-culturally. To understand this, we are conducting mixed methods research longitudinally over four years to engineering students at our participating universities to gauge their moral dispositions and ethical reasoning skills and to measure any change in these. This work-in-progress paper, however, is not about the direct outcomes of this research project. Rather, it critically examines our own practices and methods in doing this research. We begin the paper by briefly introducing the larger research project and motivating the use of comparative, multi-institutional case studies as necessary for contextualizing, complementing, and interpreting quantitative data on ethical reasoning and moral dispositions. Because the conditions related to engineering ethics education differ widely per participating institution for institutional (and also likely cultural) reasons, interpreting and analyzing quantitative survey data will require understanding contextual conditions of education at each institution. Comparative case studies can supply missing contextual information to provide a more complete picture of the engineering ethics educational contexts, strategies, and practices at each of the participating universities. However, in considering how to design and conduct these case studies, we realized we were operating under certain assumptions such as ethics in engineering as separate (and separable from) the “real,” or technical engineering curriculum. These assumptions have been widely problematized in engineering ethics education (Cech, 2014; Tormey et al. 2015; Polmear et al. 2019); they are assumptions that we in our teaching and research attempt to dispel. Our paper considers (and invites discussion on) the broader implications of methodological design in conducting cross-cultural multi-sited case studies in engineering ethics education research. It explores models for designing and conducting our case studies so as not to reproduce pernicious ideas about social and ethical issues in engineering as subsidiary “interventions” in the “actual,” (i.e., technical) curriculum. More generally we discuss how engineering ethics education research methods can be harnessed to overcome this established division.

  5. Abstract Efforts to promote responsible conduct of research (RCR) should take into consideration how scientists already conceptualize the relationship between ethics and science. In this study, we investigated how scientists relate ethics and science by analyzing the values expressed in interviews with fifteen science faculty members at a large midwestern university. We identified the values the scientists appealed to when discussing research ethics, how explicitly they related their values to ethics, and the relationships between the values they appealed to. We found that the scientists in our study appealed to epistemic and ethical values with about the same frequency, and much more often than any other type of value. We also found that they explicitly associated epistemic values with ethical values. Participants were more likely to describe epistemic and ethical values as supporting each other, rather than trading off with each other. This suggests that many scientists already have a sophisticated understanding of the relationship between ethics and science, which may be an important resource for RCR training interventions.
