Title: Engaging with the Nagoya Protocol on Access and Benefit-Sharing: recommendations for noncommercial biodiversity researchers
Abstract The Convention on Biological Diversity and the Nagoya Protocol on Access and Benefit-Sharing provide an international legal framework that aims to prevent misappropriation of the genetic resources of a country and ensure the fair and equitable sharing of benefits arising from their use. The legislation was negotiated at the behest of lower-income, biodiverse countries to ensure that benefits derived from research and development of genetic resources from within their jurisdictions were equitably returned and could thereby incentivize conservation and sustainable use of biodiversity. Despite good intentions, however, rapid adoption of access and benefit-sharing measures at the national level, often without participatory strategic planning, has hampered noncommercial, international collaborative genetic research with counterproductive consequences for biodiversity conservation and sustainable use. We outline how current implementation of the Convention of Biological Diversity and the Nagoya Protocol affect noncommercial research, such as that conducted in many disciplines in biology, including mammalogy. We use a case study from Brazil, an early adopter, to illustrate some current challenges and highlight downstream consequences for emerging pathogen research and public health. Most emerging pathogens colonize or jump to humans from nonhuman mammals, but noncommercial research in zoonotic diseases is complicated by potential commercial applications. Last, we identify proactive ways for the mammalogical community to engage with the Convention on Biological Diversity and the Nagoya Protocol, through sharing of nonmonetary benefits and working with local natural history collections. Leveraging international scientific societies to collectively communicate the needs of biodiversity science to policy makers will be critical to ensuring that appropriate accommodations are negotiated for noncommercial research.  more » « less

    ‘The Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from their Utilization’ is a supplementary agreement to the Convention on Biological Diversity. The Protocol was adopted in 2010 and came into force in 2014. Its primary purpose is to promote the fair sharing of benefits that arise from the use of genetic resources and traditional knowledge associated with those resources. The Protocol’s legal framework aims to create transparency and generate incentives to conserve and use genetic resources sustainably. The United States is not a party to the Nagoya Protocol, but many other countries have ratified it and are implementing regulations to enforce compliance in terms of access to genetic resources and benefit-sharing. Any scientist conducting research involving genetic material or traditional knowledge in other countries must be aware of these regulations and the steps they must take to comply. The Ecological Society of America is participating in a multi-society outreach effort to help researchers effectively navigate the Protocol’s legal requirements when planning and conducting international research. One outcome of this effort is the Nagoya Protocol Learning Portal (learnnagoya.com). This poster will highlight current resources available to support researchers who need to comply with Nagoya Protocol requirements in different countries, focusing on the Nagoya Protocol Learning Portal. We will highlight the results of community discussions and planning, focusing on helpful guides and templates that have been developed, example use cases, examples of compliant research workflows, and the list of curated literature and resources. We invite meeting attendees to join this learning community and connect with other scientists to share resources, experiences, and learn about opportunities to engage in wide-ranging discussions about the Nagoya Protocol. We hope that highlighting the results of these outreach efforts will increase awareness and enhance conversations about access, benefit-sharing, and forming productive international collaborations in the ESA community.

With dramatic advancements in biological data generation, genetic rescue and reproductive technologies, and inter-institutional coordination of care across entire animal populations, zoos, aquariums, and their collaborators are uniquely positioned to lead population-wide research benefiting animal wellbeing and species survival. However, procedural and inter-institutional barriers make it exceedingly difficult to access existing zoological biospecimens and data at scale. To address this, the Zoonomics Working Group, representing diverse roles across three zoological associations (AZA, EAZA, WAZA), proposes a biodiversity biobank alliance that develops and delivers shared resources to support the collection, storage, and sharing of biological samples and associated data across the zoological and conservation community. By biobank alliance, we mean a community-guided effort that develops shared resources, standards, ethos, and practices for collecting, storing, and sharing biological samples and associated data voluntarily through transparent processes, consistent with professional accreditation standards and international best practices. While initially focused on addressing the needs and regulatory landscape of U.S. institutions, the alliance is designed to create frameworks that are adaptable and adoptable for international expansion. Such a framework would help the zoological community navigate the ethical, legal, and practical challenges of managing biospecimen collections, making access more efficient, reliable, and robust. Achieving this vision requires collective agreement on ethical principles such as reciprocity, transparency, and data stewardship, ensuring that research is both feasible and proactively supported. Such coordination will drive advances in fundamental biology and accelerate progress in animal health, welfare, management, and biodiversity conservation.

  3. The field of genomics has benefited greatly from its “openness” approach to data sharing. However, with the increasing volume of sequence information being created and stored and the growing number of international genomics efforts, the equity of openness is under question. The United Nations Convention of Biodiversity aims to develop and adopt a standard policy on access and benefit-sharing for sequence information across signatory parties. This standardization will have profound implications on genomics research, requiring a new definition of open data sharing. The redefinition of openness is not unwarranted, as its limitations have unintentionally introduced barriers of engagement to some, including Indigenous Peoples. This commentary provides an insight into the key challenges of openness faced by the researchers who aspire to protect and conserve global biodiversity, including Indigenous flora and fauna, and presents immediate, practical solutions that, if implemented, will equip the genomics community with both the diversity and inclusivity required to respectfully protect global biodiversity.

Feedbacks are an essential feature of resilient socio-economic systems, yet the feedbacks between biodiversity, ecosystem services and human wellbeing are not fully accounted for in global policy efforts that consider future scenarios for human activities and their consequences for nature. Failure to integrate feedbacks in our knowledge frameworks exacerbates uncertainty in future projections and potentially prevents us from realizing the full benefits of actions we can take to enhance sustainability. We identify six scientific research challenges that, if addressed, could allow future policy, conservation and monitoring efforts to quantitatively account for ecosystem and societal consequences of biodiversity change. Placing feedbacks prominently in our frameworks would lead to (i) coordinated observation of biodiversity change, ecosystem functions and human actions, (ii) joint experiment and observation programmes, (iii) more effective use of emerging technologies in biodiversity science and policy, and (iv) a more inclusive and integrated global community of biodiversity observers. To meet these challenges, we outline a five-point action plan for collaboration and connection among scientists and policymakers that emphasizes diversity, inclusion and open access. Efforts to protect biodiversity require the best possible scientific understanding of human activities, biodiversity trends, ecosystem functions and—critically—the feedbacks among them.

  5. Abstract Classification of the biological diversity on Earth is foundational to all areas of research within the natural sciences. Reliable biological nomenclatural and taxonomic systems facilitate efficient access to information about organisms and their names over time. However, broadly sharing, accessing, delivering, and updating these resources remains a persistent problem. This barrier has been acknowledged by the biodiversity data sharing community, yet concrete efforts to standardize and continually update taxonomic names in a sustainable way remain limited. High diversity groups such as arthropods are especially challenging as available specimen data per number of species is substantially lower than vertebrate or plant groups. The Terrestrial Parasite Tracker Thematic Collections Network project developed a workflow for gathering expert-verified taxonomic names across all available sources, aligning those sources, and publishing a single resource that provides a model for future endeavors to standardize digital specimen identification data. The process involved gathering expert-verified nomenclature lists representing the full taxonomic scope of terrestrial arthropod parasites, documenting issues experienced, and finding potential solutions for reconciliation of taxonomic resources against large data publishers. Although discordance between our expert resources and the Global Biodiversity Information Facility are relatively low, the impact across all taxa affects thousands of names that correspond to hundreds of thousands of specimen records. Here, we demonstrate a mechanism for the delivery and continued maintenance of these taxonomic resources, while highlighting the current state of taxon name curation for biodiversity data sharing.
