Title: Techno-mediated Justice: How Restorative Justice Practitioners Use VideoConferencing Platforms and What HCI Can Learn from Them
Since the beginning of the COVID-19 pandemic, videoconferencing platforms have become an essential part of our social, educational, and work lives. Furthermore, the United States continues to grapple with criminal justice reform, employing processes such as restorative justice to replace antiquated punitive approaches to justice with a focus on the multifaceted needs of communities. Essential to the delivery of restorative justice, restorative justice practitioners are community members trained in the process and approaches of restorative practice. Like everyone else, restorative justice practitioners have transitioned from historically in-person facilitation to online facilitation, integrating videoconferencing platforms into their justice-related work. Diverse communities within Human-Computer Interaction (HCI) have been examined in light of their digital transitions and the utilization of various digital tools, including videoconferencing platforms prompted by the pandemic. However, the distinctive perspective of restorative justice practitioners in adapting restorative approaches to an online format is unexplored. Therefore, our research examines how restorative practitioners use videoconferencing platforms for justice-related interventions. To do so, we conducted six semi-structured focus group interviews with 22 US-based restorative facilitators to learn about their experiences with online delivery of restorative justice. Our research revealed that restorative facilitators uphold restorative values in their online delivery by embracing the restorative facilitation process and fostering dialogue.   1. Most social media platforms implement content moderation to address interpersonal harms such as harassment. Content moderation relies on offender-centered, punitive approaches, e.g., bans and content removal. We consider an alternative justice framework, restorative justice, which aids victims in healing, supports offenders in repairing the harm, and engages community members in addressing the harm collectively. To assess the utility of restorative justice in addressing online harm, we interviewed 23 users from Overwatch gaming communities, including moderators, victims, and offenders; such communities are particularly susceptible to harm, with nearly three quarters of all online game players suffering from some form of online abuse. We study how the communities currently handle harm cases through the lens of restorative justice and examine their attitudes toward implementing restorative justice processes. Our analysis reveals that cultural, technical, and resource-related obstacles hinder implementation of restorative justice within the existing punitive framework despite online community needs and existing structures to support it. We discuss how current content moderation systems can embed restorative justice goals and practices and overcome these challenges.

  2. Online harm is a prevalent issue in adolescents’ online lives. Restorative justice teaches us to focus on those who have been harmed, ask what their needs are, and engage in the offending party and community members to collectively address the harm. In this research, we conducted interviews and design activities with harmed adolescents to understand their needs to address online harm. They also identified the key stakeholders relevant to their needs, the desired outcomes, and the preferred timing to achieve them. We identified five central needs of harmed adolescents: sensemaking, emotional support and validation, safety, retribution, and transformation. We find that addressing the needs of those who are harmed online usually requires concerted efforts from multiple stakeholders online and offline. We conclude by discussing how platforms can implement design interventions to meet some of these needs.

  3. Social media users may perceive moderation decisions by the platform differently, which can lead to frustration and dropout. This study investigates users’ perceived justice and fairness of online moderation decisions when they are exposed to various illegal versus legal scenarios, retributive versus restorative moderation strategies, and user-moderated versus commercially moderated platforms. We conduct an online experiment on 200 American social media users of Reddit and Twitter. Results show that retributive moderation delivers higher justice and fairness for commercially moderated than for user-moderated platforms in illegal violations; restorative moderation delivers higher fairness for legal violations than illegal ones. We discuss the opportunities for platform policymaking to improve moderation system design.

    Abstract Problem-based learning (PBL) has been effectively used within BME education, though there are several challenges in its implementation within courses with larger enrollments. Furthermore, the sudden transition to online learning from the COVID-19 pandemic introduced additional challenges in creating a similar PBL experience in an online environment. Online constrained PBL was implemented through asynchronous modules and synchronous web conferencing with rotating facilitators. Overall, facilitators perceived web conferencing facilitation to be similar to in-person, but noted that students were more easily “hidden” or distracted. Students did not comment on web conferencing facilitation specifically, but indicated the transition to online PBL was smooth. Course instructors identified that a fully synchronous delivery as well as modifications of Group Meeting Minutes assignments as potential modifications for future offerings. Future work will aim to address the perceptions and effectiveness of web conferencing facilitation for PBL courses within an undergraduate BME curriculum, as web conferencing could prove to be another significant breakthrough in addressing challenges of problem-based learning courses.

Global protests and civil unrest in 2020 has renewed the world’s interest in addressing injustice due to structural racism and oppression toward Black and Latinx people in all aspects of society, including computing. In this article, we argue that to address and repair the harm created by institutions, policies, and practices that have systematically excluded Black and Latina girls from computer science, an intersectional, transformative justice approach must be taken. Leveraging testimonial authority, we share our past 8 years of experience designing, implementing, and studying Digital Youth Divas, a programmatic and systemic approach to encouraging middle school Black and Latina girls to participate in STEM. Specifically, we propose three principles to counter structural racism and oppression embedded in society and computing education: computing education must (1) address local histories of injustice by engaging community members; (2) counter negative stereotypes perpetuated in computer science by creating inclusive safe spaces and counter-narratives; and (3) build sustainable, computational capacity in communities. To illustrate each principle, we provide specific examples of the harm created by racist policies and systems and their effect on a specific community. We then describe our attempt to create counter structures and the subsequent outcomes for the girls, their families, and the community. This work contributes a framework for STEM and computing educators to integrate transformative justice as a method of repairing the harm that both society and the field of computing has and continues to cause Black and Latinx communities. We charge policy makers, educators, researchers, and community leaders to examine histories of oppression in their communities and to adopt holistic, transformative approaches that counter structural oppression at the individual and system level.
