Title: A global digital identity for all: the next evolution
This paper chronicles the emergence of digital identity as a legal concept, how digital identity has grown in importance at the national level over the past decades and is now poised to become even more important internationally. This work builds on existing scholarship, to consider the next evolution of digital identity from what is now essentially a national concept into a global, legal concept. The examination looks to the likely emergence of a global digital identity for individuals in the near future and asks how that could be achieved. The authors examine the use of blockchain technology as a possible foundation of a global digital identity, along with the necessary development of existing international law on individual rights to support a global digital identity for all. Blockchain is viewed as relatively more secure and it enables individuals to have more control over how their identity information is managed and used. Blockchain’s traceability pro vides advantages for government and the private sector in man aging and verifying identity. It aids the integrity of identity information and related transactions. However, it is important to note that, while blockchain has advantages, its relative immutability can lead to the creation and use of false digital identities that cannot be easily detected or corrected. As this paper discusses, this aspect can undermine the integrity and reliability of digital identity nationally and internationally. Given that blockchain tech nology is fallible, the authors argue that international law has a vital role now and in the future in recognizing the right to digital identity and establishing norms of conduct.  more » « less

  1. Blockchain is a decentralized, digital, and distributed ledger which allows transparent and secure information sharing among the peer-to-peer network. It eliminates the need for a centralized trusted party and, though it was introduced as the backbone technology for cryptocurrencies but has proved to be a promising and revolutionary technology for almost all global industries. The application of blockchain technology in the energy sector proposes a paradigm of solutions to problems of different levels of complexity in the traditional energy ecosystem. Extensive research has been proposed to exploit the inherent benefits of blockchain technology for the integration of distributed energy sources and facilitate peer-to-peer energy trading. This paper proposes a blockchain-based architecture to facilitate secure and decentralized energy trading generated from renewable energy sources. The solution utilizes the Ethereum blockchain and Smart Contracts for energy trading among the members of a small community without any trusted third entity and adopts features to achieve data integrity and confidentiality, and user identity privacy.

  2. Abstract Computational systems, including machine learning, artificial intelligence, and big data analytics, are not only inescapable parts of social life but are also reshaping the contours of law and legal practice. We propose turning more law and social science (LSS) attention to new technological developments through the study of “law in computation,” that is, computational systems' integration with regulatory and administrative procedures, the sociotechnical infrastructures that support them, and their impact on how individuals and populations are interpellated through the law. We present a range of cases in three areas of inquiry ‐ algorithmic governance, jurisdiction and agency ‐ on issues such as immigration enforcement, data sovereignty, algorithmic warfare, biometric identity regimes, and gig economies, for which examining law in computation illuminates how new technological systems' integration with legal processes pushes the distinction between “law on the books” and “law in action” into new domains.We then propose future directions and methods for research. As computational systems become ever more sophisticated, understanding the law in computation is critical not only for LSS scholarship, but also for everyday civics.

In contrast, international environmental law contains several novel international legal mechanisms aimed at addressing the effects of colonialism and global injustices that arise from the disproportionate contributions to — and impacts of — climate change and biodiversity loss.

  4. As our lives become more dependent on digital technology, cyber crime is increasing in our society. There is now an ever-increasing need to counter cyber crime through digital forensics investigations. With rapid developments in technology such as cloud computing, the Internet of Things, and mobile computing, it is vital to ensure proper training of law enforcement personnel and judges in the theory and practice of digital forensics. In this paper, we describe our methods and approach to create curricula, educational materials, and courses for training law en- forcement and judicial personnel in digital forensics. We partnered with legal experts to design a series of modules/courses on digital forensics to educate the actual target demographics. Training materials have been designed to be not only scalable to nationwide law enforcement and ju- dicial professionals, but also amenable to regular updates to respond to rapidly changing attacks and forensic techniques.

  5. The unambiguous reality of human civilization is that we now are globally interconnected. This fact is revealed by ‘world wars’, which happened for the first time in the history of humankind only in the last century. In context, global human population size has grown more than 1000% since the advent of the nation-state with the Treaty of Westphalia in 1648. During this period, the influence of Science, Technology and Innovation (STI) has been expanding, certainly since the industrial revolution around 1800 when the human population reached 1 billion, accelerating to 8 billion people as we enter the next decade during our digital revolution. The challenges are on a planetary scale, as reflected further by concern about Earth’s climate, crossing the spectrum of sub-national to international jurisdictions with the nation-state at the centre. As an example, science diplomacy from the polar regions illustrates how transatlantic science relations are embedded into a global context. With hope and inspiration from the perspective of a practitioner and observer, the evolution of science diplomacy is shared herein with local-global applications as an international, interdisciplinary and inclusive (holistic) process, involving informed decision-making to balance national interests and common interests for the benefit of all on Earth across generations.
